Study Permit Application Refusals

Individuals who have applied for a Canadian study permit but have been refused may have the option to reapply or seek professional assistance with their application process. This page provides an overview of the steps you can take if your study permit application has been denied by the Canadian government.

Reasons for Refusal

Immigration, Refugees and Citizenship Canada (IRCC) typically provides applicants with a letter detailing the reasons for a study permit refusal. Some common reasons for refusal may include:

Inability to demonstrate sufficient financial capacity to support oneself while studying in Canada.
Failure to pass a required medical exam.
Inability to convince the immigration officer that the primary intent of coming to Canada is to study.
Doubts about whether the applicant will leave Canada after their study period ends.

Depending on the reasons for the refusal, applicants may have options to:

Address the stated reasons and prepare a new application.
Seek assistance from a lawyer for a formal review of the decision.

Review of Canadian Study Permit Requirements

If an application for a study permit is refused, the first step is to review the eligibility criteria. To be eligible for a study permit in Canada, prospective international students must:

Have been accepted by a designated learning institution in Canada.
Demonstrate sufficient funds to cover:
Tuition fees,
Living expenses for themselves and any accompanying family members,
Return transportation for themselves and any family members coming to Canada.
Be a law-abiding citizen with no criminal record and not pose a security risk to Canada (a police certificate may be required).
Be in good health and willing to undergo a medical examination if necessary.
Convince an immigration officer that they will leave Canada at the end of their authorized stay.

Exceptions to these criteria may apply for foreign representatives to Canada and their families, members of foreign armed forces from certain countries, foreign nationals with Registered Indian status, and individuals wishing to undertake short-term study programs (less than six months) in Canada.

Applying for a Review of the Decision

Refusals for a study permit usually occur when the applicant fails to meet one or more of the eligibility criteria. If an applicant can demonstrate that they do satisfy the criteria, they may have grounds to seek a review by the Federal Court of Canada.

In most instances, a lawyer must file the application for judicial review on behalf of the study permit applicant.
