Overview

The Spousal Sponsorship program falls under the Family Class immigration category, allowing a Canadian citizen or permanent resident (the sponsor) to sponsor their spouse, common-law, or conjugal partner (the sponsored person) for permanent residence in Canada.

Immigration, Refugees and Citizenship Canada (IRCC) aims to process applications through the Spousal Sponsorship program within 12 months. The Open Work Permit for spouses, common-law, and conjugal partners helps alleviate the economic and emotional challenges of a lengthy application process by enabling the spouse to work while remaining with their partner.

This open work permit is not tied to a specific employer or job, allowing the holder to work for nearly any Canadian employer without needing to secure a confirmed job offer in advance.

Eligibility Criteria

To be eligible for an open work permit, the foreign national must:

Be the principal applicant who has submitted a permanent residence application under the Spouse or Common-Law Partner in Canada Class, or be a spouse, common-law, or conjugal partner under the family class that has been accepted for processing by IRCC after passing a completeness check, without being refused or withdrawn.
Submit a work permit application requesting a duration of up to two years.
Be the subject of a sponsorship application submitted by their Canadian citizen or permanent resident spouse, common-law, or conjugal partner.
Share the same residential address as their sponsor in Canada at the time of application.
Hold valid temporary resident status in Canada or be eligible for and have applied for the restoration of their status.
Both the applicant and the sponsor must meet all eligibility requirements for spousal or common-law partner sponsorship.
