While the H-1B program provides a promising pathway for skilled foreign nationals to work in the United States, it is fraught with challenges, making the U.S. a less viable option for many. One significant issue is the time limitation on H-1B visas; these visas can be granted for three years and may be extended for an additional three years. After this period, the foreign national must remain outside the U.S. for at least one full year.
Due to these and other common issues associated with H-1B visas, many foreign nationals are turning their attention to Canada for their next employment opportunity.
Canada offers several work authorization options that either have similar eligibility criteria to H-1B visas or provide foreign nationals the opportunity to continue their careers in North America.
Global Talent Stream: This facilitated work permit option targets foreign nationals in the IT sector. Many of the eligible occupations align with the “specialty occupation” criteria defined in the H-1B program, simplifying the transition to a Canadian work permit
Intra-Company Transfer: Many foreign nationals on H-1B visas are employed by multinational companies with a presence in Canada. Certain categories of H-1B workers may qualify for a facilitated Canadian work permit through the Intra-Company Transfer program.
Intra-Company Transfer Start-Up: Foreign nationals working for U.S. companies seeking to establish a presence in Canada can be eligible for facilitated work permits. These permits allow them to work in Canada to initiate operations for a Canadian branch, subsidiary, or affiliate
CUSMA: Mexican citizens holding an H-1B visa can qualify for a facilitated work permit in Canada under the Canada-United States-Mexico Agreement (CUSMA) if they are qualified to work in a specific occupation and are coming to Canada for that purpose. Business Visitors: H-1B visa holders traveling to Canada for work-related purposes may qualify as business visitors in specific situations, allowing them to be exempt from needing a work permit.
