Authorization to Return to Canada

When a foreign national is requested to leave Canada, they often need to apply for an Authorization to Return to Canada (ARC) to re-enter the country legally.

This process involves formally requesting permission from the Canadian government to return, even after having been asked to depart.

Overview

In most cases, an Authorization to Return to Canada (ARC) cannot be submitted as a standalone application; it typically accompanies another application and is processed in conjunction with it. The only exception is for applicants from visa-exempt countries, who can submit an ARC application independently. However, if a visa is needed to visit, study, or work in Canada, the ARC will not be a separate application, but rather included with the visa process, with an associated fee of $459.55 CAD.

The phrase “being asked to leave” encompasses various actions the Canadian government may take to ensure that a foreign national departs. Whether an ARC is required depends on the specific measures enacted.

Departure Order

Those who receive a departure order must exit Canada within 30 days and confirm their departure with an immigration officer. If they follow these requirements, they generally do not need to apply for an ARC. However, if they fail to comply with the departure order, it will be converted into a deportation order, which carries different consequences.

Exclusion Order

Individuals who receive an exclusion order must wait 12 months from their departure before they can apply to re-enter Canada, and they need a certificate of departure confirming this period has elapsed. If these conditions are met, they typically do not require an ARC when applying to return. However, if they seek to enter Canada before the 12-month waiting period is over, an ARC will be necessary.

Deportation Order

Individuals who receive a deportation order, including those whose departure order has transitioned into a deportation order, must obtain an ARC to re-enter Canada legally.

It’s important to differentiate these orders from a Direction to Leave Canada, which does not require an ARC.

If you were deported due to criminal inadmissibility, you will likely need to apply for either Criminal Rehabilitation or a Temporary Resident Permit (TRP) to enter Canada lawfully.
